Please read our Conditions of Sale carefully. Receipt of your order will indicate that you agree wholly to our Conditions of Sale. Contract for the Supply of Products or Services The display of goods on the Tri-Ard Stainless Fasteners Ltd site amounts to an invitation to treat only and is not an offer to sell products or services at any price indicated. No contract for the supply of products or goods will be deemed to exist between you and Tri-Ard Stainless Fasteners Ltd unless, and until, an email is sent by Tri-Ard Stainless Fasteners Ltd to you confirming that your order has been accepted and payment has been successfully made. This confirmation e-mail amounts to an acceptance by Tri-Ard Stainless Fasteners Ltd of your offer to buy goods or services from Tri-Ard Stainless Fasteners Ltd and this acceptance is effective regardless of whether or not you receive this e-mail. Tri-Ard Stainless Fasteners Ltd are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself. Price and availability information is subject to change without notice. In the event of an outbreak of hostilities (whether war is declared or not) in which the United Kingdom is involved, or in the event of national emergency, or if the Company’s work should become either directly or indirectly so engaged on Government orders or orders under priority directions as to prevent or delay work on other orders, the Company shall be entitled at any time on notice to the Customer, to make partial deliveries only or to determine the contract, without prejudice in any case to rights accrued in respect of deliveries already made. Goods supplied by the Company which are not from normal stock or which is specially made or obtained for a Customer shall not be returned to the Company without the Company’s prior consent. The Company shall not be liable for consequential loss suffered by the Customer as a result of defects in goods supplied or delayed, short or non-delivery of goods. Deliveries may be wholly or partially suspended and the time of such suspension added to the original contract in the event of a stoppage, delay or interruption of work in the establishment of either the Company or the Customer during the period as a result of strikes, lock-outs, trade disputes, breakdown, accident or any cause whatsoever beyond the control of the Company or the Customer respectively. Age Restrictions Where you place an order for age-restricted goods such as solvents and knives, you confirm that you are over the age of 18 and that delivery will be accepted by a person over the age of 18. We reserve the right to cancel your order if we reasonably believe you are not legally entitled to order certain goods. No part of it may be reproduced in any form or stored electronically or in any other medium without the permission of Tri-Ard Stainless Fasteners Ltd. For your personal (as opposed to commerical) use you may store or print material from the website. Tri-Ard Stainless Fasteners Ltd is providing this site and its contents on an ‘as is’ basis and makes no representations or warranties of any kind with respect to the site or its contents. Tri-Ard Stainless Fasteners Ltd disclaims all such representation and warranties, including for exmple, warranties of merchantability and fitness for a particular purpose. In addition, Tri-Ard Stainless Fasteners Ltd does not warrant that the information accessible via this site is accurate, complete or current. Tri-Ard Stainless Fasteners Ltd does not guarantee that access to the website will be continuous or error free. Tri-Ard Stainless Fasteners Ltd will seek to ensure reasonable continuity of service and early correction of errors of which it is notified. Error connection will ordinarily take place upon the periodic review and checking of the website functionality. Tri-Ard Stainless Fasteners Ltd uses virus checking software to screen against damaging viruses but cannot be held responsible for the accidental transmission of a virus to any person. Processing of Orders Credit cards are debited before items are shipped or before services are activated by Tri-Ard Stainless Fasteners Ltd. Cancellation & Returns You may cancel your order by giving us notice of cancellation within 30 days of the date of collection or delivery. Such notice may be given by mailing, faxing or emailing to the number of addresses set out on the website. If you are cancelling because of any problems with the goods, please notify us of the problem at the time of cancellation, and return the goods to us. Goods ordered incorrectly by the customer should be returned by the customer to our premises at the customers expense. On receipt a full refund will be given less the carriage cost. With regards to Fasteners, a 25% handing charge will be applicable. With concerns to all other items, contact Tri-Ard Stainless Fasteners Ltd for up-to-date charges and procedures regarding the return and exchange of items. Goods delivered incorrectly will be collected at our expense and replaced or refunded in full on receipt at our premises. Refunds Exchange or credit to the value of the goods can be given on items returned within 14 days provided they are unused and undamaged and the purchase invoice number is quoted. Limitation of Liability Except as specifically stated on this site, neither Tri-Ard Stainless Fasteners Ltd nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. The Company shall not under any circumstances be liable to the Customer for any damage, loss or expense watsoever arising directly or indirectly from any defects in goods supplied. The Company will at the request and the expense of the customer take such steps as it considers to be reasonable in order to obtain for the Customer the benefit of any condition, warranty or guarantee given by the manufacturers of the goods and to which the customer may be entitled. Illegal Acts It is a crime to use a false name or a known invalid credit card to order. Anyone caught willfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic ‘fingerprints’ of every order placed on this website to enable us and all legitimate crime prevention authorities to trace individual users engaging in criminal activities on our website. Changes in Terms Tri-Ard Stainless Fasteners Ltd reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the data and time of posting on the Tri-Ard Stainless Fasteners Ltd website. In the event that any of these terms and conditions shall become or shall be declared by any court of competent jurisdiction to be invalud or un-enforcable, in any way such invalidity or un-enforceability shall in no way impair or affect any of the other conditions hereof all of which shall remain in full force and effect. |
